1. Scope and Acceptance
These Terms of Service (“Terms”) govern your access to and use of the Swiss Guide mobile application (“App”), available on iOS and Android, operated by InfinitX KLG, Wolfbühlstrasse 34b, 8408 Winterthur, Switzerland, UID: CHE-194.754.696 (“we”, “us”, “Swiss Guide”). If you are looking for the Terms of Use governing the Swiss Guide website, please visit www.swissguide.app/terms. By downloading, installing, or using the App, you confirm that you have read, understood, and accept these Terms and our Privacy Policy. Acceptance occurs when you check the box indicating your agreement during the registration flow. If you do not accept, you may not use the App.
2. Eligibility
Swiss Guide is intended exclusively for users aged 16 and above. By using the App, you confirm that you are at least 16 years old. We do not knowingly provide services to persons under 16. If we become aware that a user is under 16, we may suspend or delete the account and associated data without undue delay. Parents or guardians who believe their child has registered may contact us at support@swissguide.app.
3. Account Registration
An account is required to access certain features of the App. You must provide accurate, current, and complete information during registration and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@swissguide.app if you suspect unauthorised access to your account. We reserve the right to refuse registration or suspend accounts at our discretion.
4. Licence to Use the App
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on your device solely for personal, non-commercial purposes. This licence does not include the right to copy, modify, reverse engineer, or use the App for commercial purposes without our prior written consent.
5. User Content
By submitting content such as reviews or text (“User Content”), you grant InfinitX KLG a worldwide, non-exclusive, royalty-free licence to use, store, display, and distribute your User Content within the App. You warrant that you own or have the necessary rights to submit your User Content and that it does not infringe any third-party rights.
6. Prohibited Conduct
You agree not to use the App to post content that is illegal, harmful, hateful, threatening, or discriminatory; to infringe any intellectual property, privacy, or other rights of third parties; to submit false, misleading, or inaccurate information; to spam, phish, or engage in deceptive practices; to attempt to gain unauthorised access to the App or its systems; to use bots, scrapers, or automated systems to access or extract data; to interfere with or disrupt the App or its servers; or to violate any applicable law or regulation.
7. App Content and Accuracy
Swiss Guide provides curated travel content including place descriptions, photos, tips, and maps for informational purposes only. We do not guarantee that any content is complete, current, or error-free. You should independently verify information before making travel decisions.
8. Safety Notice
Visiting destinations displayed in the App may involve physical risks, including outdoor and alpine environments. Swiss Guide does not assess the safety of any location. You are solely responsible for assessing risks, checking official local guidance and weather conditions, and taking appropriate precautions before visiting any place or undertaking any activity.
9. Premium Features and In-App Purchases
Certain features are available exclusively to Premium or Premium Plus subscribers. Subscriptions are processed through the Apple App Store or Google Play Store and renew automatically unless cancelled at least 24 hours before the end of the current period. Cancellation must be made through your App Store account settings. Offline access to Premium content requires an active subscription. Refunds are governed by the applicable App Store policies.
10. Advertising
The App displays clearly labelled sponsored content from third-party advertising partners. We do not endorse advertisers’ products or services and are not responsible for the content of third-party advertisements or linked websites. The Broadcast Channel may in the future include sponsored or promotional content, which will be clearly labelled.
11. Broadcast Channel
The Broadcast Channel delivers editorial and informational content to subscribed users, including new content announcements, seasonal travel recommendations, and Travel Tips. By enabling Broadcast Channel notifications, you consent to receiving these messages. You may unsubscribe at any time via the app settings without affecting your access to any other features.
12. Premium Plus Chat Feature
Premium Plus subscribers have access to a direct chat feature for personalised travel advice and trip planning assistance. The chat feature is available exclusively to active Premium Plus subscribers. Chat messages are stored and may be reviewed by Swiss Guide staff to provide accurate responses and improve the service. You agree not to submit personal data of third parties, sensitive personal information, or any content that violates these Terms via the chat. Swiss Guide does not guarantee response times and reserves the right to moderate or terminate chat access in the event of misuse. Travel information and advice provided via chat is for informational purposes only and Swiss Guide is not liable for decisions made based on chat advice. Chat messages are retained in accordance with the Privacy Policy.
13. Push Notifications
By enabling push notifications, you consent to receiving notifications from Swiss Guide for the following purposes: new places and spots added to the App; new Travel Tips published; new messages in the Broadcast Channel; and new chat messages for Premium Plus subscribers. You can withdraw consent at any time via your device settings. Withdrawal does not affect notifications already delivered.
14. Creator Code and Referral System
Swiss Guide operates a Creator Code system that allows users to support a creator by entering their unique code at registration. By entering a Creator Code, you will be permanently attributed to the creator whose code you used, including for any future paid subscription. Attribution is automated and binding. The Creator Code system is intended for genuine referrals only. The following conduct is strictly prohibited and may result in immediate account suspension and forfeiture of commissions: creating accounts using your own Creator Code (self-referrals); artificially generating registrations or Premium subscriptions; using fake accounts, bots, or automated systems to inflate referral counts; and any other deceptive or fraudulent use of the Creator Code system. We actively monitor for abuse and reserve the right to withhold commissions, void fraudulent registrations, terminate accounts, and pursue legal action where applicable. If you use Swiss Guide in the context of influencer marketing, you must represent the App truthfully, clearly label all promotional content as advertising in accordance with applicable law and platform guidelines, comply with the guidelines of any social media platform used for promotion, and not make false or exaggerated claims about the App.
15. Intellectual Property
All content within the App – including text, graphics, images, logos, and software – is the property of InfinitX KLG or its licensors and is protected by applicable intellectual property law. Nothing in these Terms grants you any rights to use our trademarks or proprietary materials without prior written consent.
16. Limitation of Liability
The App is provided “as is” without warranties of any kind. We do not warrant that the App will be uninterrupted or error-free. InfinitX KLG is not liable for indirect, incidental, special, or consequential damages, or for any loss or damage arising from visiting any destination featured in the App. Travel information and chat advice are for informational purposes only and we are not liable for decisions made based on content provided through the App. Our total liability for any claim shall not exceed the amount paid by you in the preceding 12 months, or CHF 100, whichever is greater.
17. Indemnification
You agree to indemnify and hold harmless InfinitX KLG from any claims, damages, costs, and expenses arising from your use of the App, your User Content, your use of the chat feature, or your violation of these Terms, including any misuse of the Creator Code system.
18. Account Suspension and Termination
We may suspend or terminate your account at any time if we believe you have violated these Terms. Upon termination, your licence to use the App ceases immediately and access to all Premium and Premium Plus features is revoked.
19. Changes to the App and Terms
We may modify, suspend, or discontinue any part of the App at any time. Material changes to these Terms will be communicated via the App or email at least 14 days before taking effect. Continued use after changes take effect constitutes acceptance of the revised Terms. The current version is always available at www.swissguide.app/app-terms.
20. Governing Law and Jurisdiction
These Terms are governed by Swiss law, excluding conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the courts of Winterthur, Switzerland, unless mandatory consumer protection laws in your country of residence provide otherwise.
